VPS Hosting with Mattermost Platform

INTRODUCTION

Welcome to our VPS Hosting with Mattermost Platform Terms of Service Agreement (“TOS”, “Agreement”, or “Terms”). Please read these Terms carefully as they govern your use of our virtual private server (VPS) hosting services with Mattermost platform implementation.

By accessing or using our Services, you agree to be bound by these Terms. If you are using our Services on behalf of an organization, you are agreeing to these Terms on behalf of that organization and you represent that you have the authority to bind that organization to these Terms. In such cases, “you” and “your” will refer to that organization.

1. SERVICES DESCRIPTION

1.1 VPS Hosting Services

We provide Kernel-based Virtual Machine (KVM) VPS hosting services that include:

  • Allocated CPU, RAM, and storage resources as specified in your selected plan
  • Root access to your virtual server
  • SSD/NVMe storage
  • Network bandwidth as specified in your plan
  • IP address allocation

1.2 Mattermost Platform Implementation

Our services include implementation of the Mattermost communication platform on your VPS. This may include:

  • Installation of Mattermost server software
  • Basic configuration of the Mattermost platform
  • Integration with your specified authentication systems (where applicable)

2. ACCOUNT AND BILLING

2.1 Account Creation

To use our Services, you must create an account and provide accurate, complete information. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

2.2 Payment Terms

All fees are due in advance and non-refundable unless otherwise stated. We may suspend or terminate your Services if payment is not received when due. Pricing is subject to change with notice provided at least 30 days in advance.

2.3 Service Term and Renewal

Unless otherwise specified, all Services are provided on a monthly basis and will automatically renew until canceled. You may cancel at any time, but no refunds will be issued for partial billing periods.

2.4 Additional Fees

The following additional fees may apply:

  • Maintenance fees for services beyond standard support
  • Customization fees for modifications to standard configurations
  • Data migration fees for importing data from other platforms
  • Backup restoration fees for retrieval of backed-up data (where space permits)

3. CUSTOMER RESPONSIBILITIES

3.1 Acceptable Use

You agree to use our Services for lawful purposes only and in accordance with this Agreement. You shall not use our Services to:

  • Engage in any illegal activities
  • Distribute malicious code or malware
  • Engage in hacking, cracking, or unauthorized system infiltration
  • Conduct or participate in denial-of-service attacks
  • Host, store, or transmit content that infringes on intellectual property rights
  • Distribute unsolicited bulk emails (spam)
  • Host, store, or transmit sexually explicit, obscene, or defamatory content
  • Engage in cryptocurrency mining without prior written permission
  • Exceed bandwidth or resource allocations in a manner that disrupts service

3.2 System Modifications

You acknowledge that any modifications you make to the system configuration that result in security vulnerabilities, excessive resource usage, or service disruptions may result in service suspension or termination. You are responsible for:

  • Maintaining proper security practices for your VPS
  • Keeping all software up-to-date with security patches
  • Configuring your VPS appropriately to prevent abuse
  • Using strong authentication measures

3.3 Data Backup

You are responsible for maintaining your own regular backups of all data. While we may offer backup services where space permits, you acknowledge that:

  • We do not guarantee the availability or completeness of any backups
  • We are not liable for any data loss regardless of cause
  • You should maintain independent backups of all critical data

4. SERVICE PROVIDER RIGHTS AND RESPONSIBILITIES

4.1 Service Availability

We strive to maintain high availability of our Services but do not guarantee 100% uptime. Scheduled maintenance will be announced in advance whenever possible.

4.2 Support Services

Basic technical support is included with all VPS hosting plans. Additional support services may be available for an additional fee.

4.3 Security Measures

We implement reasonable security measures to protect our infrastructure, but you are responsible for securing your VPS and the applications you install on it, including Mattermost.

4.4 Service Modifications

We reserve the right to modify our Services at any time, including:

  • Updating system software
  • Changing hardware infrastructure
  • Modifying features or functionality
  • Changing service terms and pricing

4.5 Service Suspension or Termination

We reserve the right to suspend or terminate Services for:

  • Violation of these Terms
  • Non-payment of fees
  • Excessive resource usage affecting other customers
  • Security concerns or vulnerabilities
  • Legal requirements or government orders
  • System modifications that result in attacks or excessive loads

5. MATTERMOST-SPECIFIC TERMS

5.1 Software License

The Mattermost server software is subject to its own licensing terms. You agree to comply with all applicable Mattermost license terms. You understand that:

  • We do not provide Mattermost licenses but only the hosting environment
  • You are responsible for obtaining any necessary Mattermost licenses
  • Your use of Mattermost must comply with Mattermost’s terms of service

5.2 Data Processing

You acknowledge that:

  • You are the data controller for any personal data processed through Mattermost
  • You will comply with all applicable data protection laws
  • You will obtain all necessary consents for data processing

6. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • YOUR USE OR INABILITY TO USE THE SERVICES
  • ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN
  • ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICES
  • ANY DATA LOSS FOR ANY REASON

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US FOR THE SERVICES DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

8. INDEMNIFICATION

You agree to defend, indemnify, and hold us harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable attorney’s fees and costs, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

9. AMENDMENTS TO TERMS

We may update these Terms from time to time. If we make material changes, we will notify you via email or through the Services. Your continued use of the Services after such notification constitutes acceptance of the updated Terms.

10. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law principles.

11. DISPUTE RESOLUTION

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, terrorism, riots, or war.
